Article 1 (Purpose)
These Terms and Conditions define the terms and procedures for using all services (hereinafter referred to as the "Services") provided by CESS, as well as the rights, obligations, and responsibilities between CESS and its members, and other necessary matters.
Article 2 (Definitions)
  • "Member" refers to a person who has registered as a member by providing personal information to CESS and can use the services provided by CESS.
  • Membership is only available to those who are members of "SAJ", "CANSI", "SEA Europe", or "KOSHIPA" (hereinafter referred to as the "Associations")
Article 3 (Posting and Revision of Terms)
  • CESS shall post these Terms and Conditions on the initial service screen so that members can easily understand them.
  • CESS may revise these Terms and Conditions to the extent that it does not violate relevant laws such as the Act on the Regulation of Terms and Conditions and the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc.
  • In the event that CESS revises these Terms and Conditions, it shall notify members of the effective date and reasons for the revision by posting the revised Terms and Conditions along with the current Terms and Conditions on the initial service screen from 7 days before the effective date to the day before the effective date
Article 4 (Formation of Service Agreement)
  • A service agreement is established when a person who wishes to become a member (hereinafter referred to as the "Applicant") agrees to these Terms and Conditions, fills out the membership information according to the membership form designated by CESS, applies for membership, and CESS approves the application.
  • CESS may refuse to approve applications that fall under any of the following:
    • The Applicant does not belong to a member company of the Associations.
    • The name is not real or uses the name of another person.
    • False information is provided, or the information requested by CESS is not provided.
    • Other requirements for membership application set by CESS are not met
Article 5 (Changes to Member Information)
  • Members can view and modify their personal information at any time through the personal information management screen.
  • If any information provided during the membership application process changes, members must modify it online or notify CESS of the changes by email or other means.
  • CESS is not responsible for any disadvantages caused by failure to notify CESS of the changes in paragraph 2
Article 6 (Obligation to Protect Personal Information)
CESS strives to protect the personal information of its members in accordance with the Information and Communications Network Act and other relevant laws and regulations. The protection and use of personal information are subject to relevant laws and CESS's Privacy Policy
Article 7 (Obligations of CESS)
  • CESS shall not engage in any acts prohibited by law or these Terms and Conditions or contrary to public order and morals, and shall make every effort to provide services continuously and stably.
  • CESS shall establish a security system to protect personal information (including credit information) so that members can use the services safely, and shall disclose and comply with the Privacy Policy
Article 8 (Obligations of Members)
  • Members must fill out all information based on facts using their real names when applying for membership or changing their member information. If false information or information of another person is registered, they cannot claim any rights.
  • Members must comply with the matters stipulated in these Terms and Conditions, other regulations set by CESS, notices announced by CESS, and relevant laws and regulations. They must not engage in any acts that interfere with CESS's business or damage CESS's reputation
Article 9 (Provision and Change of Services)
  • If CESS changes the Services, it shall notify members of the contents of the changed Services and the date of provision in the manner prescribed in Article 3.
  • CESS may restrict or suspend all or part of the Services in any of the following cases:
    • In case of unavoidable circumstances such as maintenance or construction of service facilities
    • When a telecommunications carrier stipulated in the Telecommunications Business Act suspends telecommunications services
    • In case of a national emergency, power outage, failure of service facilities, or excessive use of services that hinders the normal use of services
Article 10 (Provision of Information and Posting of Advertisements)
  • CESS may post various information on the service screen or provide it to members by email, postal mail, or other means in the course of operating the Services.
  • CESS may post advertisements on the service screen, homepage, email, etc., in connection with the operation of the Services
Article 11 (Termination of Agreement and Restriction of Use)
  • Members may request termination of the service agreement at any time through the customer center on the initial service screen or the My Information Management menu, and CESS shall process it immediately in accordance with relevant laws and regulations.
  • CESS may terminate the service agreement or suspend the use of services without prior notice if a member falls under any of the following:
    • The member loses their membership in a member company of the Associations.
    • The member intentionally interferes with the operation of CESS services.
    • The member violates the obligations of members stipulated in Article 8
Article 12 (Compensation for Damages)
  • CESS shall not be held liable for the use of free services unless otherwise specified by relevant laws.
  • If CESS incurs damages due to a member's violation of these Terms and Conditions, the member who violated these Terms and Conditions shall compensate CESS for all damages incurred
Article 13 (Disclaimer)
  • CESS shall be exempt from liability for the provision of services in the event of natural disasters or other force majeure events that render the provision of services impossible.
  • CESS shall not be liable for any disruptions in service use due to the member's fault.
  • CESS shall not be liable for any loss of expected profits from using the services.
  • CESS shall not be liable for any damages caused by data obtained while using the services.
  • CESS shall not be liable for the reliability, accuracy, etc., of information, data, or facts posted by members on the services
Article 14 (Dispute Resolution)
  • CESS shall establish and operate a damage compensation processing body to reflect legitimate opinions or complaints raised by users and to compensate for their damages.
  • CESS shall give priority to handling complaints and opinions submitted by users. However, if prompt processing is difficult, CESS shall immediately notify the user of the reason and processing schedule.
  • Disputes arising between CESS and members may be subject to mediation by the Electronic Commerce Mediation Committee established pursuant to Article 28 of the Electronic Commerce Basic Act and Article 15 of the Enforcement Decree of the same Act
Article 15 (Jurisdiction and Governing Law)
  • Any lawsuit regarding electronic commerce disputes arising between CESS and members shall be filed with the court having jurisdiction under the Civil Procedure Act.
  • The laws of the Republic of Korea shall apply to electronic commerce lawsuits filed between CESS and members.
